Stepping Into the New Year, Legal Wins, and What’s Next for Creators

1️⃣ Meta Was Down—Why Does This Matter for Creators?

Earlier this month, Instagram and Facebook experienced a major outage, leaving creators scrambling. The takeaway? Don’t put all your eggs in one basket. 

Diversifying your platforms—and ensuring your contracts cover disruptions—is more important than ever. Add Force Majeure clauses to the important sections you want to review/add. Here are some more clauses to look out for in your contracts.

2️⃣ TikTok Ban on the Horizon

A U.S. appellate court upheld the trial court’s decision in favor of the U.S. government that could see TikTok banned if its parent company, ByteDance, doesn’t sell by mid-January 2025. 

TikTok appealed, of course, so now it’s up to the Supreme Court. The highest Court has the option to hear the case, but there is no indication they will, and it doesn’t appear they are in any rush to grant certiorari. If they don’t, the ban will go into effect on January 19th. If they do, there will be a stay on the ban while the Court reviews the case. 

Most likely, the Court will defer to Congress or the President. Congress’ position is most likely a ban as they have national security concerns that have some merit. But there are also more pressing issues facing our country at this time, and they may not want to put more energy into this one.

As for the President, Biden can save TikTok by executive order, as written into the legislation, if he wants but has made no indication he will. Trump originally proposed the ban but has since backed down from that position. Unfortunately for the app, he can't do anything because the ban will go into effect the day before he gets sworn in. 

Personally, I think there will be an 11th-hour sale even though ByteDance has stressed they would never sell. The U.S. may not be their largest market, but something tells me they don’t want to lose it either.

The Parties have been in negotiations for months, so let's see if they can strike a deal before the holidays. 

What does this mean for you? For creators who rely on TikTok, now’s the time to:

  1. Secure brand collaborations on multiple platforms and save important content.

  2. Make sure contracts include platform-specific protections - force majeure clauses and alternative platform language. 

  3. Build ownership over your audience through newsletters or websites. Make sure your audience can find you!!
